For example, a second or subsequent possession charge for marijuana is a Class 1 misdemeanor punishable by up to 12 months in jail and a $2,500 fine.
  • Distribution or trafficking. Except for persons authorized under the Virginia Drug Control Act, it is a crime to sell, give or distribute controlled substances. You can be charged with distributing drugs even if you do not get paid for doing so. The penalties for trafficking in drugs can be severe, even for first-time offenses.
  • Possession with intent to distribute. It is a crime in Virginia to possess drugs with the intent to distribute them. The penalties for possession with the intent to distribute are more severe than the penalties for possession.
